  10. GRANT.  Netscape grants you a non-exclusive license to use this Beta
  11. version of the Netscape software (the "Software") free of charge for
  12. evaluation and trial purposes only.  THIS SOFTWARE CONTAINS CODE THAT
  13. DISABLES MOST OF ITS FEATURES AFTER MARCH 31, 1997.  This license
  14. does not entitle you to hard-copy documentation, support or telephone
  15. assistance.  While Netscape intends to distribute a commercial release
  16. of the Software, Netscape reserves the right at any time not to release
  17. a commercial release of the Software or, if released, to alter prices,
  18. features, specifications, capabilities, functions, licensing terms,
  19. release dates, general availability or other characteristics of the
  20. commercial release.  You may make a single copy of the Software for
  21. archival purposes, provided such copy must contain all of the original
  22. Software's proprietary notices.

  24. DISCLAIMER OF WARRANTY.  The Software is provided on an "AS IS" basis,
  25. without warranty of any kind, including without limitation the
  26. warranties of merchantability, fitness for a particular purpose and
  27. non-infringement.  The entire risk as to the quality and performance of
  28. the Software is borne by you.  Should the Software prove defective, you
  29. and not Netscape or its suppliers assume the entire cost of any service
  30. and repair.  In addition, the security mechanisms implemented by
  31. Netscape software have inherent limitations, and you must determine
  32. that the Software sufficiently meets your requirements.  This
  33. disclaimer of warranty constitutes an essential part of the agreement.
  34. SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS OF AN IMPLIED WARRANTY, SO
  35. THIS DISCLAIMER MAY NOT APPLY TO YOU AND YOU MAY HAVE OTHER LEGAL
  36. RIGHTS THAT VARY BY JURISDICTION.

  38. LIMITATIONS.  You may not:
  39.     permit other individuals to use the Software except under the terms
  40.     listed above;
  41.  
  42.     permit concurrent use of the Software;
  43.  
  44.     modify, translate, reverse engineer, decompile, disassemble (except
  45.     to the extent applicable laws specifically prohibit such
  46.     restriction), or create derivative works based on the Software;
  47.  
  48.     copy the Software other than as specified above;
  49.  
  50.     rent, lease, grant a security interest in, or otherwise transfer
  51.     rights to the Software; or
  52.  
  53.     remove any proprietary notices or labels on the Software.
  54.  
  55. TITLE.  Title, ownership rights, and intellectual property rights in
  56. the Software shall remain in Netscape and/or its suppliers.  The
  57. Software is protected by copyright and other intellectual property laws
  58. and by international treaties.  Title and related rights in the content
  59. accessed through the Software is the property of the applicable content
  60. owner and may be protected by applicable law.  This license gives you
  61. no rights to such content.
  62.  
  63. TERMINATION.  The license will terminate automatically if you fail to
  64. comply with the limitations described herein.  Upon termination of this
  65. license, or in any event within thirty (30) days following Netscape's
  66. release of a commercial version of the Software, you agree to destroy
  67. all copies of the Software.
  68.  
  69. EXPORT CONTROLS.  None of the Software or underlying information or
  70. technology may be downloaded or otherwise exported or reexported (i)
  71. into (or to a national or resident of) Cuba, Iraq, Libya, Sudan, North
  72. Korea, Iran, Syria or any other country to which the U.S. has embargoed
  73. goods; or (ii) to anyone on the U.S. Treasury Department's list of
  74. Specially Designated Nationals or the U.S. Commerce Department's Table
  75. of Denial Orders.  By downloading or using the Software, you are
  76. agreeing to the foregoing and you are representing and warranting that
  77. you are not located in, under the control of, or a national or resident
  78. of any such country or on any such list.  In addition, if the licensed
  79. Software is identified as a not-for-export product (for example, in the
  80. installation process), then the following applies: EXCEPT FOR EXPORT TO
  81. CANADA FOR USE IN CANADA BY CANADIAN CITIZENS, THE SOFTWARE AND ANY
  82. UNDERLYING TECHNOLOGY MAY NOT BE EXPORTED OUTSIDE THE UNITED STATES OR
  83. TO ANY FOREIGN ENTITY OR "FOREIGN PERSON" AS DEFINED BY U.S. GOVERNMENT
  84. REGULATIONS, INCLUDING WITHOUT LIMITATION, ANYONE WHO IS NOT A CITIZEN,
  85. NATIONAL OR LAWFUL PERMANENT RESIDENT OF THE UNITED STATES.  BY
  86. DOWNLOADING OR USING THE SOFTWARE, YOU ARE AGREEING TO THE FOREGOING
  87. AND YOU ARE WARRANTING THAT YOU ARE NOT A "FOREIGN PERSON" OR UNDER THE
  88. CONTROL OF A FOREIGN PERSON.

  90. LIMITATION OF LIABILITY.  UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL
  91. THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL NETSCAPE OR ITS SUPPLIERS
  92. OR RESELLERS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT,
  93. SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER
  94. INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK
  95. STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
  96. COMMERCIAL DAMAGES OR LOSSES.  IN NO EVENT WILL NETSCAPE BE LIABLE FOR
  97. ANY DAMAGES, EVEN IF NETSCAPE SHALL HAVE BEEN INFORMED OF THE
  98. POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.  THIS
  99. LIMITATION OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR
  100. PERSONAL INJURY TO THE EXTENT APPLICABLE LAW PROHIBITS SUCH
  101. LIMITATION.  FURTHERMORE, SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION
  102. OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS
  103. LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.

  105. HIGH RISK ACTIVITIES.  The Software is not fault-tolerant and is not
  106. designed, manufactured or intended for use or resale as on-line control
  107. equipment in hazardous environments requiring fail-safe performance,
  108. such as in the operation of nuclear facilities, aircraft navigation or
  109. communication systems, air traffic control, direct life support
  110. machines, or weapons systems, in which the failure of the Software
  111. could lead directly to death, personal injury, or severe physical or
  112. environmental damage ("High Risk Activities").  Netscape and its
  113. suppliers specifically disclaim any express or implied warranty of
  114. fitness for High Risk Activities.
  115.  
  116. MISCELLANEOUS.  This Agreement represents the complete agreement
  117. concerning this license and may amended only by a writing executed by
  118. both parties.  If any provision of this Agreement is held to be
  119. unenforceable, such provision shall be reformed only to the extent
  120. necessary to make it enforceable.  This Agreement shall be governed by
  121. California law (except for conflict of law provisions).  The
  122. application the United Nations Convention of Contracts for the
  123. International Sale of Goods is expressly excluded.

  125. U.S. GOVERNMENT END USERS.  The Software is a "commercial item," as
  126. that term is defined in 48 C.F.R. 2.101 (Oct. 1995), consisting of
  127. "commercial computer software" and "commercial computer software
  128. documentation," as such terms are used in 48 C.F.R. 12.212 (Sept.
  129. 1995).  Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1
  130. through 227.7202-4 (June 1995), all U.S. Government End Users acquire
  131. the Software with only those rights set forth herein.
